Can I Get A Restraining Order If Someone Is Stalking Me?

Stalking is a violation of Nebraska laws § 28-311.02§ 28-311.03, and § 28-311.04. If someone thinks another person is stalking them, they may call the police. They may also file a petition to the district court for a protection order. A judge can sign the order without a hearing, but the other party may ask for a hearing within ten days. If a hearing takes place, both parties are able to tell their side, and the judge will decide whether to continue the protection order or to cancel it. The Nebraska Supreme Court has put together a guide to obtaining protection orders.
