What Is A Default Judgment?

The judge enters a default judgment in favor of the plaintiff in cases where the defendant receives a copy of the plaintiff´s claim form but fails to show up in court at the time set for trial. The plaintiff will be required to present the basic facts supporting his or her claim before the judge will award a default judgment.

The Plaintiff would be wise to wait 30 days to take collection action on the default judgment because after 30 days it is too late for the defendant to appeal. If the plaintiff fails to appear in court on the trial date, the case will be dismissed.
