ASUN Constitutional & Judicial Code Special Election

Special Election to Update ASUN Governing Documents

The Association of Students of the University of Nebraska–Lincoln (ASUN) is working to modernize its governing documents to better reflect the current practices, needs, and priorities of the student body.

A new Constitution has been proposed following an ASUN Student Senate Constitutional Convention. Additionally, revisions to the Judicial Code were developed in collaboration with students and faculty from the University of Nebraska–Lincoln College of Law through the Judicial Code Review Committee.

  • Why are the documents being updated?

    • ASUN's Constitution was originally ratified in 1965, more than 60 years ago.
    • The Judicial Code was ratified more than 30 years ago.
    • Despite the changes UNL and its student body have undergone since then, the Constitution has only been amended six times in six decades.
    • Both documents needed comprehensive updates to bring them into alignment with current practices and procedures

What Will Change?

What Was Missing?

  • The previous Constitution did not formally recognize the Chief of Staff, one of ASUN's five executive positions.
  • The previous governing documents lacked clearly established impeachment and recall procedures for certain elected officials.
  • The previous Constitution placed the President and Internal Vice President on one ballot, with the External Vice President elected separately. The proposed Constitution places all three positions on a single ballot.

What's New?

Greater Flexibility for Future Updates

  • Clarifies the process for proposing and approving future constitutional amendments, allowing ASUN to adapt to the evolving needs of the student body.

Modernized Language and Terminology

  • Removes gender-specific references throughout the Constitution.
  • Updates terminology to reflect current UNL practices, positions, responsibilities, and procedures.

Stronger Accountability and Checks and Balances

  • Establishes a formal impeachment process for Student Senators and a recall process for officers of the Senate.
  • Requires the President, Internal Vice President, and External Vice President to appear on the same ballot.
  • Strengthens the independence and impartiality of the Electoral Commission.

Clearer Distribution of Power

  • Expands and clarifies the Student Senate's authority in the legislative process.
  • Formally establishes standing legislative committees to distribute responsibilities and strengthen the legislative process.

A Modernized Judicial Code

  • Allows the Student Court to incorporate modern technology into its operations and proceedings.
  • Clarifies the Student Court's jurisdiction to establish appropriate boundaries and better protect students.
  • Updates outdated provisions to better reflect the current needs of the student body.
