What If The Creditor Sues Me?

If you are served papers or receive notice of a lawsuit by certified mail, contact a lawyer immediately. You will need to have a lawyer draft a response to the lawsuit within thirty days of you being served.

If you ignore the lawsuit it will not go away. The court will award a judgment against you without considering your defenses. Once the creditor has this judgment from the court it might be possible for the creditor to garnish your bank account or attach your wages or nonexempt property.
